How We Evaluate a South Carolina Anesthesia Malpractice Claim

A claimant typically must file and serve a Notice of Intent to File Suit and submit an expert affidavit containing a qualified professional’s opinion about at least one alleged negligent act or omission.
The parties also participate in pre-suit mediation, a structured attempt to address the dispute before trial. Filing a Notice of Intent can affect the applicable limitation period, but it doesn’t eliminate the need to act promptly.
Under South Carolina Code section 15-3-545, claims generally must be filed within three years of the treatment, omission, or discovery of the injury. A six-year outside limit applies to many claims. Exceptions and tolling rules may depend on when the injury was discovered, the claimant’s age, the defendant’s identity, and other circumstances, so a general deadline may not reflect the time available in a particular case.
Damages After an Anesthesia-Related Injury
Depending on the evidence and applicable law, damages may address medical treatment, rehabilitation, lost income, reduced earning capacity, pain, emotional distress, disability, disfigurement, and loss of enjoyment of life. A fatal injury may also support certain family losses through a wrongful death claim.
